Capital Punishment for the Innocent
Terry Schiavo has been sentenced to death by starvation by her husband and a judge. She committed no crime. Where are all the opponents of capital punishment and why aren't they defending her? Here's a video of Schiavo which shows this is still a human being who deserves our compassion.

The involvement of the United States Congress in the Schiavo case is inexcusable, unjustifiable, and probably unconstitutional. The Florida legislature tried to involve itself in this 2 or 3 years ago, and it was a disaster.
This action by the Congress may have the effect of undermining state laws pertaining to all manner of things.
Then there is the blatant, bare-faced hypocrisy of Terri Schiavo's mother, who today warned others not to make her daughter's suffering part of their personal agenda--exactly what she has been doing for years in front of news cameras & microphones.
It's my view that the husband should divorce Terri (Hmmm, I wonder if Terri could sign the divorce papers--we can assume that her parents believe she could), turn over to her parents what funds remain from the settlement obtained years ago, and let them go on torturing their daughter while they continue the delusional game they are playing with her life because they just can't let go.
The videos show very little if anything about the essence of Terri, that which makes her unique as a person. The reflexes are non specific and doctors testifying in courts have said that even these weak reactions are not replicable.
But these facts do not bear on people's beliefs because even if the facts were found to be different only a small percentage of people would change their minds.
The saddest part is that this case has little to do with the woman whose life was tragically ended by a combination of bulimia and medical malpractice.
This is the modern Scopes trial to determine the existence of God.
Those who believe that a person's essence is a non-material soul will maintain that the "real" Terri is still there, a spirit trapped in a broken machine.
Those who believe that consciousness is a natural phenomenon arising from the matter of the brain will believe that Terri died when her brain was destroyed.
Do you wonder why there is such an hysterical level of charges and countercharges in this case, far beyond anything generated by O.J. or Peterson? The answer is that this is not about whether a woman lives or dies, it is about whether a worldview lives or dies.
This isn't about capital punishment. This is about a woman whose cerebral cortex is either (1) 100% atrophied, and replaced by spinal fluid, with no chance of improvement, or (2) mostly atrophied and replaced by spinal fluid, with some chance of recovery, however extremely slim.
Which one it is depends on which doctor you listen to. Mr. Schiavo's doctors say it's 100%, while Terri's parents say it's mostly gone. But it's been 15 years and she hasn't gotten any better - only worse. And I am told that the few minutes of activity you see in that video were clipped out of six hours of footage, which you don't see for some odd reason...

Florida state judges do not have the right to disobey a subpoena from the US House of Representatives. The Florida judge did just that when he rejected the subpoena and ordered that Terri Shiavo be starved to death.
The US Constitution, Article III, empowers Congress to determine the jurisdiction of federal courts. Congress recently just did that, granting federal courts jurisdiction in Terri Shiavo's case and others like it.
The only "wrong" done here was by the Florida judge who set himself above the power of a Congressional subpoena. You folk down in Florida need to make sure your judges passed 8th Grade civics class.

No, it means that she is already dead. There is no Terri Schiavo anymore, she died at least ten years ago.
Can you murder a severed arm? How about a removed kidney? For all intents and purposes the body in that hospital room is a decapitated Terri Schiavo. Could she have survived decapitation?
The concept of death means death of the personality, the end of what made Terri the person she was.
What is truly bizarre is that for me, as an atheist, I am indifferent to whether the body that was once Terri Schiavo is kept breathing or not. There is no longer a human life involved. Were she in a coma, with evidence of an intact brain, I would certainly demand that she be kept alive, but such is not the case. It is not merely that there is no brain activity, there is no brain at all, at least no cerebrum.
Yet, it is strange to me that those who believe in an afterlife would want Terri's imprisoned soul to remain on earth, trapped in a useless body, unable to communicate with those she loves, unable to move, unable to work or play. Such a horrible fate might be justice for a child rapist or a murderer, but an innocent young girl who has offended no one? Still, the devout wish this to be Terri's fate, finding such torture preferable to freeing her soul for its eternal reward.
Ok Bob, so we all know you are for Euthanasia, know nothing about the faithful, and even less about the intentions of the Constitution.

As for the subpoena, its having been ignored is confounding. But on the other hand, I get the feeling it was fired off as a delaying tactic.
I mean, what are they going to do when she goes to congress - have a committee meeting and watch her alternate between gibbering and drooling? Are they really expecting to get answers out of her?

Terri's desires were established by hearsay evidence which, though legal in Florida, should not be accepted.
This case has many issues all of which are being deliberately confused by both sides.
What were Terri's wishes?
Should hearsay be accepted in cases like this?
Is this the province of legislatures?
Is this the province of the federal government?
Is Terri actually alive in a meaningful sense?
Can Terri's condition be improved by therapy?
What does "improvement" mean for someone with such extensive brain damage?
It would have been better if the federal circuit court judge had allowed one more presentation if for no other reason than to address these issues publicly. No matter what the outcome, at least there would have been a clear public record of the facts.
It is amazing that so many putatively intelligent people, with full use of their mental faculties, insist on debating the medical merits of the Schiavo case, when what is in question is, i) the verifiability of Terri's wishes regarding care--note, not medical care, but feeding and hydration--in her circumstances (only the husband and his family claim she casually made a statement on the subject when seeing a TV show about an incapacitated person); ii) the standing of the husband, as guardian by law, to make a life-or-death decision, given his change of attitude about long-term care before and after the medical malpractice award, and given that his marital vows are compromised by his decision to start a new family; and iii) the claim of the parents and siblings to assume responsibility for her continued care given the uncertainty and uncognizable nature of her true wishes.

The Congressional subpoena ordered the state courts to submit federal court review of the case to determine if Terri Shiavo's civil rights and Constitutional guarantees of due process were not being trampled on before proceeding. Not for Terri Shiavo to testify before a Congressional commitee.
Judge Greer, by ordering the feeding tube removed in SPITE of this subpoena, basically is answering the question - "Yes, Terry Shiavo's rights are being trampled on, and I don't care."
Apparently property rights in Florida still apply to human flesh.

In just about every state in the Union, your wishes, as verbally witnessed above, with respect to the transfer of real estate would be worthless. Without a properly executed signed will, or a properly executed signed transfer of real estate, your favorite is not going to get all of the house.
But in Terri's case, the Culture of DEATH is willing to take her, with nothing but his word, against my word proof.
Real estate has more protections then a helpless person.
